Breath Alcohol Tests for EmploymentBreath Alcohol Tests for EmploymentWhat are breath alcohol tests and when can employers use them as part of pre-employment or employment screening for alcohol use?Breath alcohol testing devices, commonly known by the term for one specific brand of the device- the Breathalyzer- measure how much alcohol is currently in the blood. Blood alcohol testsalso show current levels of impairment or intoxication, but not past use.It is in contrast to tests for illegal drugs, which do show past use. How Breath Alcohol Tests Work The person being tested for alcohol use blows into a breath alcohol device, and the results are given as a number. The number, known as the blood alcohol concentration (BAC), shows the level of alcohol in the persons blood at the time the test was taken. It does not measure the past use of alcohol. When Employers Use Them Most companies that perform alcohol testing upon employees make it clear upon hiring that this is their pract ice their alcohol and drug testing policies are typically included in their employee handbooks. Refusal by employees to submit to alcohol testing may be grounds for dismissal. Employers typically use alcohol testing under specific circumstances The employer may have a policy that tests when there is reasonable suspicion, also known as probable-cause or for-cause testing, and there are documented signs of possible alcohol or drug use by an employee.Another scenario where alcohol testing may be performed is post-accident testing when there was suspected alcohol or drug use that caused property damage or personal injury accident in the workplace.Random testing may be performed on an unannounced, unscheduled basis on employees who are selected arbitrarily from a testing pool. There is mandatory alcohol testing for employees in some industries regulated by the United States Department of Transportation and the United States Department of Defense. U.S. DOT Required Testing Mandatory a lcohol and drug testing are required by the United States Department of Transportation for some occupations and industries. This mandatory testing includes trucking, aviation, maritime, pipeline, railroad, and transit employees in safety-sensitive occupations. A safety-sensitive employee in the transportation industry is an individual who provides a safe work and transportation environment for co-workers and the traveling public. The legal limit for being considered impaired by alcohol while driving is .08.However, the blood alcohol concentration that is considered impaired is a lower number than the standard driving BAC. The United States Department of Transportation regulations mandates that a 0.04 a positive alcohol test requires removal of an employee from driving or other safety-sensitive tasks. A 0.02 result, under DOT regulations, can require removal from tasks for a certain period of time. In addition, there are other regulations governing alcohol use for safety-sensitive em ployees Employees must not use or possess alcohol or any illicit drug while assigned to perform safety-sensitive functions or while actually performing safety-sensitive functions.Employees must not report for tafelgeschirr or remain on duty if they are under the influence or impaired by alcohol.Employees must not use alcohol within four hours (eight hours for flight crew members and flight attendants) of reporting for service or after receiving the notice to report. Pre-Employment Screening The United States Department of Transportation specifies when applicants can be tested for alcohol as part of pre-employment screening The testing must be performed upon all applicants for a position.The testing must be conducted as a post-offer requirement. Blood/Breath Alcohol Concentration (BAC) Calculators There are calculators available to compute your estimated blood/breath alcohol concentration based on the number of drinks you have consumed and how quickly you drank them, your wei ght, and your gender. In general, 1 ounce of alcohol stays in a persons system for 1.5 hours. Legal Issues There are no federal laws prohibiting alcohol or drug testing. However, some individual states restrict employers from random drug testing of employees other than those in safety-sensitive positions. Also, someone with a history of alcoholism may be considered a qualified individual with a disability under theAmericans with Disabilities Act (ADA)and other federal nondiscrimination statutes.

Its a nice thought, but unfortunately, thats not the case for most people. Sometimes this requires taking steps to repair your partieal brand. While perfection is nice to shoot for, the rest of us mere mortals occasionally pull a career-limiting move (yes, it has its own abbreviation of CLM). When that happens, you have to move into damage control to help mitigate the possible harm it could do to your career.There are two big questions that loom over you in these situationsCan you repair your Personal Brand? Answer YesWill people forget? Answer Sometimes and it can happen with the right steps.Lets look at both questions and what you can do.Repair Your Personal BrandAcknowledge and take responsibility. No one likes a person with no integrity. We cheer for people who arent afraid to admit to their blunders. Its that moment in time we all relate to our frailties and hope we will be big enough to do the same. Also, people can tell when you are sidestepping and that is almost as inexcusable as the bad deed, sometimes worse. Step up and take responsibility.Apologize. Most likely, whatever you did will require some apologies to various people. You negatively impacted the business or work-mates or both. Part of taking responsibility for a CLM is acknowledging to specific people you get it about whatever you did. When you do this, dont make excuses, dont reassign blame, and dont add comments to lighten up the impact. If you do those things, people will not believe you and that will be another blunder.Make a repair plan. As part of your acknowledgement of your CLM, you need to also be prepared with a plan to make things as right as you can possibly make them. It might not be much, but something is better than nothing.Execute flawlessly. If you say you are going to do something, do it. Now is not the time for you to become a slack er. People are watching to see if they need to permanently rethink your Personal Brand. Dont give them a reason to hit the reset button.Erase Their MemoryBe consistent. Its funny how our collective memory works. Sometimes we quickly forgive and forget peoples mistakes but not always. You can see evidence of this with our celebrities. The best way to help people forget is to be consistent in reinforcing your good Personal Brand. Over time, they will regain confidence in what to expect from you.A bit more self-promotion. Lets face it we all have to do some self-promotion. For a while, you might need to step yours up a bit more to simply make your good work more obvious to people.Give people a reason to like you. Even if you were loved before, that love may be shaken. Go out of your way to be helpful. Volunteer for projects or activities that will put you with others in a new way. Spend time nurturing the relationships. Its especially important to win over an alpha in the group because people will follow their lead of supporting you. Sometimes this is hard because shame can cause us to retreat- dont do that.Know when to leave. Sometimes, the damage is not something you can overcome without long-term career impact. Give all of this some time to get back into place, but at some point, you need to read the situation. If your read is that its not going to go back to a supportive environment, you need to cut your losses and leave. You can reclaim your good Personal Brand in new stomping grounds.We all get advice to lean-in to our strengths, and you should. Its also good to recognize that things wont always go well and its equally important to show you are a person of character.
